You could go after him - but check your house insurance first. You may be covered for legal expenses in cases of employment dispute. If you are covered then you may be able to go after your employer via a lawyer that you get for free through your insurance. If they think you have a case they'll act for you, but that will probably mean you have to resign and then go after your employer for constructive dismissal and non-payment of wages.

This is protracted and stressful. Some people enjoy it (sense of vindication, money back etc) - most don't. Also, if the business is going up the swannee anyway then I'd suggest you'd never get your money. I think you'd be better off, less stressed, and more empowered (ghastly term, but I can't think of any other) to just quit your job and get another one.

As someone who's worked for a small company for 16 years, we have always been paid on time, even when cash was very tight and other bills went late. Cash flow is a pain in the arse sometimes but if this is happening to you on a regular basis then I'd look for another job pretty soon.

You also need to make sure that the PAYE (national insurance and income tax deductions) have been paid by the employer by the 19th of each subsequent month. If he's not paying you, then there's a very good chance he's not paying hmrc on time either.
